Terms of Service
The agreement
These terms govern use of Kaiedo at https://kaiedo.com. Using the service means accepting them. Where
a subscriber has a separate signed agreement with Kaiedo, that agreement takes precedence.
What Kaiedo provides
Kaiedo builds and hosts a website for a business, provides tools to run the parts of that business
it touches — enquiries, bookings, customers, reviews, marketing — and connects businesses to one
another. What is included depends on the plan.
The account
A subscriber is responsible for what happens under their account, for keeping their sign-in
secure, and for the accuracy of what they publish. An account may have several people on it with
different levels of authority; the account holder decides who has what.
The business's own content, and its customers
A business owns what it publishes and owns its customer records. Kaiedo holds them on that
business's behalf and does not use them for anything other than running the service for them.
A business is responsible for its own legal obligations to its customers — including its own
privacy policy, its own consent to contact them, and its own obligations under the Spam Act 2003
and the Privacy Act 1988. Kaiedo provides tools that record consent and support erasure; it does
not become the business's legal representative.
The network
Businesses may connect to one another. A connection is by mutual agreement, and either side may
withdraw. Where one business hands work to another through Kaiedo, what travels is what was
stated — Kaiedo does not warrant the other business, its work, or its conduct, and a connection
made through Kaiedo is a commercial arrangement between those two businesses alone.
Acceptable use
Do not use Kaiedo to publish unlawful content, to impersonate somebody, to send unsolicited
commercial messages, to attempt to reach another tenant's data, or to interfere with the service.
Kaiedo may suspend an account that does.
Payment
Fees, billing period and inclusions are as shown at the time of subscribing. Fees are payable in
advance. A subscription may be cancelled at any time and runs to the end of the paid period.
Availability
Kaiedo aims to keep the service and the websites it hosts available, and does not guarantee
uninterrupted availability. Planned maintenance is notified where practical.
Ending it
A subscriber may stop at any time. Kaiedo may end an account for a serious or repeated breach of
these terms, with notice where circumstances allow. On ending, a business may export its data;
what is then retained and for how long is covered by the privacy policy.
Liability
Nothing here excludes rights that cannot be excluded under the Australian Consumer Law. Subject
to that, Kaiedo's liability is limited to the fees paid in the twelve months before the claim, and
Kaiedo is not liable for indirect or consequential loss.
Governing law
These terms are governed by the law of Queensland, Australia.
